Response to recent FDA decision

Today, the U.S. Food and Drug Administration (FDA) denied premarket tobacco product applications (PMTA) for our Vuse Alto Menthol and Mixed Berry Pods.

• These denials do not impact the status of the PMTAs for the Vuse Alto Device, Golden Tobacco Pods, or Rich Tobacco Pods, which are awaiting further review by FDA. 
• Vuse intends to seek a stay of enforcement immediately as to the decision on Vuse Alto Menthol Pods.

We are disappointed in this decision. We are pursuing appropriate legal avenues in order to allow Vuse to offer its innovative products, including Vuse Alto Menthol and Mixed Berry Pods, to adult nicotine consumers age 21+. Although we disagree with the FDA’s decision, we remain committed to working alongside the agency to create A Better Tomorrow™.

Today, a court granted an emergency stay of enforcement. Our Vuse Alto Menthol Pods remain available for sale.
